These Terms of Service govern your use of the website at evermark-media.com and any services provided by Evermark Media LLC ("Evermark Media," "we," "us," or "our"). By accessing our website or engaging our services, you agree to these terms.
Evermark Media provides social media management, short-form video production, paid advertising creative, brand photography, and related digital marketing services. Specific deliverables, timelines, and fees are defined in individual client agreements or proposals.
Retainer services are invoiced monthly. Project work is invoiced at 50% upfront and 50% upon delivery unless otherwise stated in writing. All invoices are due within 7 days of issuance unless a Net 30 term has been explicitly agreed upon in writing. Late payments may result in paused services.
Upon receipt of full payment, clients receive a license to use deliverables produced by Evermark Media for their business purposes. Evermark Media retains the right to display work in its portfolio and marketing materials unless a written confidentiality agreement is in place. Raw footage, project files, and unused assets remain the property of Evermark Media unless otherwise agreed in writing.
Clients are responsible for providing accurate brand information, timely approvals, and any necessary access to accounts or assets. Delays caused by client inaction may affect delivery timelines without penalty to Evermark Media.
Evermark Media does not guarantee specific results, follower counts, engagement rates, or revenue outcomes from its services. Our total liability for any claim arising from services rendered shall not exceed the total fees paid in the three months preceding the claim.
Either party may terminate a service agreement with 30 days written notice. Fees for work completed prior to termination are due in full. Minimum contract terms must be honored as agreed.
These terms are governed by the laws of the State of Washington. Any disputes shall be resolved in Whatcom County, Washington.
